1. Acceptance of Terms
By accessing or using ProtoVoice services, you agree to be bound by these Terms of Service and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Service Description
ProtoVoice provides AI-powered voice agents for business phone communications, including call answering, appointment scheduling, customer support, and related features. Our services include the ProtoVoice platform, APIs, dashboards, and any associated documentation.
3. Account Registration
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials
- You must notify us immediately of any unauthorized access
- One person or entity may not maintain multiple free accounts
- You must be at least 18 years old to create an account
4. Acceptable Use
- Do not use our services for illegal purposes or to violate any laws
- Do not impersonate others or misrepresent your identity
- Do not transmit malware, spam, or harmful content
- Do not attempt to gain unauthorized access to our systems
- Do not interfere with or disrupt our services or infrastructure
- Do not use our services for telemarketing without proper consent
- Do not record calls without appropriate disclosure where required by law
5. Payment Terms
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specified in our refund policy. We may change pricing with 30 days notice. Failure to pay may result in service suspension or termination.
6. Intellectual Property
ProtoVoice and its licensors retain all rights to the platform, including software, designs, and documentation. You retain ownership of your content and data. By using our services, you grant us a license to process your content as necessary to provide the services.
7. Data and Privacy
Your use of our services is subject to our Privacy Policy. You are responsible for ensuring you have appropriate consent to process any personal data through our platform, including call recordings. For regulated industries, you are responsible for ensuring your use complies with applicable regulations (HIPAA, PCI-DSS, etc.).
8. HIPAA Compliance
For healthcare customers handling Protected Health Information (PHI), ProtoVoice offers HIPAA-compliant services. A Business Associate Agreement (BAA) must be executed before processing any PHI through our platform. See our Compliance page for more details on our HIPAA compliance program.
9. Service Availability
We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice. We are not liable for service interruptions due to factors beyond our control. Check our Status page for real-time availability information.
10. Limitation of Liability
To the maximum extent permitted by law, ProtoVoice shall not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. Some jurisdictions do not allow these limitations, so they may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless ProtoVoice and its affiliates from any claims, damages, or expenses arising from your use of our services, your violation of these terms, or your violation of any third-party rights.
12. Termination
You may cancel your account at any time through the dashboard or by contacting support. We may suspend or terminate accounts for violations of these terms with or without notice. Upon termination, you may request export of your data within 30 days.
13. Modifications to Terms
We may modify these terms at any time. Material changes will be communicated via email or platform notification at least 30 days in advance. Continued use after changes take effect constitutes acceptance of the modified terms.
14. Governing Law
These terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.
